Service Policies

Equine Design 4 U provides web hosting, email services and domain services.  Equine Design 4 U reserves the right to suspend or cancel any client's access to any portion or all of Equine Design 4 U services, when Equine Design 4 U deems that the account has been used inappropriately.  Equine Design 4 U reserves the right to refuse service and/or access to its servers to anyone.

  • User Policy
     

    1. Illegal activities.  Equine Design 4 U prohibits sites engaged in: Illegal activities including, but not limited to, storing and/or distributing illegal copies of copyrighted software, warez sites, violations of copyrights and trademarks, violations of U.S. laws, selling and/or distributing illegal contraband.
    Internet abuse including, but not limited to, spamming (unsolicited Emailing), distribution of mass emailing programs, cross-posting messages to a large number of usenet groups, posting obscene or inflammatory messages, threatening other Internet users, mail bombing Internet users, running packet sniffers or port scanners, spamming Equine Design 4 U support staff.  Systems abuse including, but not limited to, use of excessive CPU resources, use of excessive disk space, use of excessive email storage space, hacking our systems, installing continuously running programs, such as IRC bots, reselling CGI scripts.

    2.Adult content: We do not allow the presentation, promotion or transmission of adult, pornographic or obscene images, text or other content. The determination of what is "adult content" and therefore prohibited shall be solely made by Equine Design 4 U.

    3.Policy Violations: Should a policy violation occur, Equine Design 4 U reserves the right to terminate the account without notice and without any refunds. The policy violating client will be held responsible for any damages to Equine Design 4 U , including but not limited to, Equine Design 4 U system, servers, connectivity, reputation, business, service, network, operations, or equipment.  The policy violator may be charged a $500 clean up fee. 

     

    Web Site Content

    The client is responsible for keeping a copy of their most current web site files as backup on a remote system (not on Equine Design 4 U servers). Equine Design 4 U is not responsible for any lost files, information, or data. Should any data need to be recovered, there will be a charge of $100. 
    The above applies to Hosting Clients Only. 
    Equine Design 4 U does retain backup files for all clients where we design the website. 

     

    Support

    Free customer support is provided via email and through 1-830-443-4614.  Billing inquiries will be answered within two business days. Equine Design 4 U does not provide custom programming and scripting, or web site consulting services as part of our hosting services* This applies to Hosting Clients Only*  Call or email for more details*
     

    Payment Policy and Fees
    Pricing and Payment
    I accept checks, money order, all major credit cards via Paypal. What ever works for you.  (Keep in mind, making a payment through paypal will go through faster, and will ensure a quicker response.) I require 1/2 of your total website costs paid in full before I will begin to design your site.  I believe this is fair as I do charge less than half of what most web designers ask. 

     You will be billed yearly (on renewal of your domain and hosting).

    Please note:  There is a 25.00 fee applied to payments received in the five days after invoice due date.  After five days past invoice due date in a non payment situation, your website will be
    removed from the server and other fees will apply to reinstate your website.  I do not renew or
    set up domains or hosting plans without payment.

     

    The minimum contract period is 1 year.  All services are available in one year prepayment plans.

    Full payment is required before any hosting service is rendered, which includes renewals. All  payment-due notices will be sent by electronic mail.  No bills or invoices will be sent by postal mail or fax.  Prepayment is due each anniversary following the date the account was established. 

     

    Package sites are given thirty (45) days and within those thirty (45) days you may send unlimited graphics, photos, verbiage, page set-up, etc. Once your site is set-up, you are honored FIVE free text changes (updates, wording changes, etc.)  and photo changes per month. Text changes thereafter start at $1.50 per change, minimum of $5.00. The addition and subtraction of pictures is a charge $3.00 per picture. A complete layout change is a charge of $50.00 per page.

     

    Refund Policy

    If Equine Design 4 U  terminates an account due to policy violation, there will be no refund.  Fees associated with additional features are non-refundable.
     

    Cancellation

    Equine Design 4 U  reserves the right to terminate service at any time.  If an account is terminated for a policy violation there will be no refund.  Equine Design 4 U  reserves the right to delete the policy-violating web site content without notice.

    Customers can cancel service at any time.  All account cancellations are to be requested through the client's control panel AND via email.  If the client requests cancellation, their account will be terminated at the end of the current billing cycle, or immediately.  If the client specifies immediate account termination, Equine Design 4 U reserves the right to delete the web site contents without notice.  If an account is cancelled due to non-payment, Equine Design 4 U  reserves the right to delete the web site contents without notice. Should the Equine Design 4 U  client decide to keep the web site content information for re-use, the content may be purchased at $250.00+, and the content will be forwarded to the new server and/or web designer. Because Equine Design 4 U  does not have a set-up fee, there are no exceptions to this policy. Designs must be paid for out-right.
     

    Indemnification

    Client agrees to defend, indemnify and hold harmless Equine Design 4 U against any liabilities arising out of defective products sold to customers from Equine Design 4 U servers, personal injury or property damage caused by products or services sold or distributed from Equine Design 4 U servers, any material that infringes or allegedly infringes on the rights of a third party available from Posh servers, and any material that libels or allegedly libels a third party available from Equine Design 4 U servers.
     

    Disclaimer

    Equine Design 4 U  is not responsible for any damages to any client's business. Posh makes no warranties or guarantees of any kind, expressed or implied for services that we provide. Use of Posh web hosting and email service is at the client's sole risk. Equine Design 4 U  services are provided on an "as is, as available" basis.  Equine Design 4 U  does not guarantee that our services will be uninterrupted or error free.  Equine Design 4 U  will provide every effort in good faith to ensure that its services are available to as many Internet users as possible with minimal service interruptions.

    In no circumstance will Equine Design 4 U be liable for any claims resulting from the use or inability to use Equine Design 4 U  services including, but not limited to, service interruptions, client errors, Internet connectivity problems, miscommunications, unauthorized access to Equine Design 4 U servers, InterNIC problems, DNS caching, Internet bandwidth congestion, power failures, vandalism, and natural disasters.
     

    Equine Design 4 U reserves the right to revise our policies at any time.
